General Terms of Use – VRdirect App

The VRdirect GmbH, Einsteinstr. 174, 81677 Munich, Germany (hereinafter ‘VRdirect’) provides a VRdirect App through various distribution platforms (App Store, Google Play Store, Oculus, etc.) for download. Interactive VR projects can be accessed and played in the VRdirect App. Below you will find the General Terms of Use (hereinafter ‘Terms of Use’) for the VRdirect App. By downloading or using the App, you (hereinafter ‘USER’) agree to the validity of these terms of use. You can access, print and save these terms of use in the current version in the VRdirect App itself and on our website www.vrdirect.com.

1. Conclusion of Contract
The usage agreement comes into effect through the download. You must be at least 16 years old to use the VRdirect App.

2. Subject-matter of the contract

2.1. Virtual Reality content created with the VRdirect Studio software and currently published and released on the VRdirect Platform can be accessed and played with the VRdirect App.

2.2. The subject-matter of this contract is the granting of a simple, non-exclusive, non-sublicensable, non-transferable, free of charge and time limited right of use of the VRdirect App and its contents.

2.3. The right to use includes access to the VRdirect App as well as the use of the currently available functionalities.

2.4. The currently available Virtual Reality contents published on the VRdirect Platform may be copied to the memory of the device and played for purely personal, non-commercial use.

2.5. The USER receives the App only in executable form. The source code is not handed-over. Additional services such as: Updates, maintenance of the App, etc. are not owed.

2.6. Furthermore, it is prohibited to edit, change, translate, display or present, publish, exhibit, reproduce or distribute the VRdirect App and the contents available in the VRdirect App in whole or in part. Likewise, it is prohibited to use, disguise, remove or change copyright notices, logos and other markings or protective markings, reproductions of trademarks and names.

3. Access and Functions of the VRdirect App

3.1. The VRdirect App will be made available to the USER for download.

3.2. For the installation and use of the VRdirect App and its contents, an internet-enabled device is required and is provided for various operating systems. An internet connection is necessary for the initial installation, updates and also for the use of the VRdirect App. Partially the data is stored locally so that the VRdirect App can be used offline for certain functionalities. VRdirect is not responsible for compliance with the system requirements. These are the sole responsibility of the USER.

3.3. Using the VRdirect App requires no registration and no password.

3.4. The VRdirect App is designed to access and view Virtual Reality content created by the VRdirect Studio and currently released for publication on the VRdirect Platform.

4. Cost
It is a free App. No costs or fees will be charged for the provision and use of the VRdirect App.

Note: However, you must provide specific terminals, software, and data connections for the initial installation, usage and upgrade of the VRdirect App. The extent and frequency of data transmission depends on the type and extent of use of the VRdirect App. You are responsible for all connection costs or data tariffs and taxes of your provider for the data transmission of your mobile device. The amount depends on your existing contract with your telecommunications provider.

5. Availability, Right to make changes, Updates

5.1. A claim to the use of the VRdirect App exists only within the scope of the technical and operational possibilities of VRdirect. VRdirect strives to ensure that the services can be used as uninterruptedly as possible. However, technical faults (such as power interruption, hardware and software faults, technical problems in the data lines) can result in temporary restrictions or interruptions. VRdirect has no influence on the transport of data via the internet. In addition, there is no guarantee that the data exchange will take place at a certain transmission speed.

5.2. Software Updates are free of charge. The USER of the VRdirect App has no obligation to install any updates provided. However, the functionality of the VRdirect App may require that the USER has the latest version installed on his terminal device. The USER is recommended to update the VRdirect App regularly.

5.3. VRdirect strives to continuously adapt the products to current requirements. We therefore reserve the right to make changes to adapt the system to the state of the art, changes to optimize the system in particular to improve user-friendliness as well as changes to content and the discontinuance of services if necessary to correct errors, update and complete them for program optimization and licensing reasons or if this is due to technical progress or to prevent misuse. The changes may cause the appearance, navigation or functions of the App to change. VRdirect strives to ensure the user-friendliness. If the USER does not agree, he may no longer use the App. If the USER continues the use, the USER accepts the new terms of use submitted to him and the amended terms become part of the terms of use. VRdirect will inform you of the change by means of a message.

6. Liability and Note on Risk

6.1. The App is provided free of charge. It is therefore pointed out that: Statements and explanations by VRdirect about the VRdirect App in advertising materials, on websites and in the documentation are only intended as a description of the nature and not as a guarantee or assurance of a property. VRdirect makes no warranty regarding the availability, reliability, functionality or suitability of the App for your purposes. VRdirect does not provide any product support.

6.2. The VRdirect App provides access to the currently published Virtual Reality content on the VRdirect Platform. The Virtual Reality content is created by users of the VRdirect platform and is not controlled by VRdirect. VRdirect accepts no responsibility or guarantee for the completeness, content accuracy, legality, timeliness and usability of the Virtual Reality content. This also applies to the quality of the Virtual Reality content and their suitability for a particular purpose.

6.3. The VRdirect Player is not designed to display safety-relevant functions when viewing Virtual Reality content or to warn about the dangers. Therefore, any use of this App on your hardware is at your own risk.

6.4. VRdirect is liable for the recovery of data, for data loss as well as for the data corruption only if the USER has regularly made backup copies and ensured that the data from these backup copies can be reconstructed with reasonable effort. In this case, VRdirect’s liability is limited to typically foreseeable damage. Any further liability for loss of data is excluded.

6.5. Incidentally, VRdirect shall only be liable for intent and gross negligence, including for its legal representatives or vicarious agents. VRdirect shall be liable under the limitation of compensation for foreseeable damage typical for the contract for such damages, which are based on a slightly negligent breach of essential contractual obligations by us or one of our legal representatives or vicarious agents.

Essential contractual obligations are obligations whose fulfillment makes the proper execution of the contract possible in the first place and on the compliance of which the contractual partner may regularly rely. VRdirect is liable without limitation for damages resulting from injury to life, body or health as well as for damages due to non-compliance with a guarantee given by VRdirect or warranted property or due to fraudulently concealed defects. The provisions of the Product Liability Act remain unaffected. Besides, liability is excluded regardless of its legal basis.

7. Data Protection
When using the functionalities and services provided in the VRdirect App, no personal data will be processed by VRdirect unless this is necessary for the provision of services in accordance with the contract and permitted by legal regulations or is ordered by law. For details, please refer to our data protection policy in the App and on our website: www.vrdirect.com/vrdirect-app-privacy-policy.

8. Copyright and intellectual property rights
The App and the Virtual Reality content are both protected by German copyright law and international copyright treaties and other intellectual property laws and treaties. The compilation of the content as such may be protected as a database or database work. You may only use this content in accordance with these Terms of Use and the framework provided in the VRdirect App. VRdirect owns and holds all copyright exploitation rights to the VRdirect App and its content and is the creator of Virtual Reality content owner and holder of all copyright exploitation rights to their Virtual Reality content. This Agreement grants the USER certain rights of use but does not grant him any intellectual property rights.

9. High risk activities
The App and its contents are not designed or intended for use in risk environments that require error-free operation. Risk environments include in particular, the operation of nuclear facilities, aeronautical navigation systems or communications systems, air traffic control equipment, weapon systems, life support equipment or the operation of any other application where software failure may result in an immediate risk to life or limb or substantial property damage (high risk activities). VRdirect therefore rejects any contractual or legal warranty for the suitability of the App for high-risk activities.

10. Termination of the usage

10.1. The usage agreement between VRdirect and the USER of the VRdirect App is concluded for an indefinite period. The access of the respective Virtual Reality content is only possible as long as these are respectively released by the creator or VRdirect for publication on the VRdirect Platform. Termination of the VRdirect App is possible at any time by uninstalling the VRdirect Player and clearing the cache.

10.2. Notwithstanding any other rights, VRdirect may terminate the rights of use if the terms and conditions of this agreement are severely violated. VRdirect reserves the right to take further measures under civil law and criminal law.

11. Important safety instructions Virtual Reality contents are 3D media content
For the use of the Virtual Reality content, use only high-quality 3D glasses and 3D-capable equipment and in accordance with their operating instructions and their safety instructions. Besides, please read the following warnings carefully:

11.1. It is possible to experience an epileptic seizure when exposed to 3D media content. Therefore, do not consider Virtual Reality content if you have epilepsy. In addition, you should not consume Virtual Reality content if you are pregnant, suffer from severe dizziness, seizures, uncontrolled loss of consciousness, impaired vision, anxiety, heart disease or other serious medical conditions.

11.2. Please note that the following symptoms may occur when viewing 3D media content: involuntary movements, altered vision; dizziness; lightheadedness; eye or muscle twitching / fatigue; confusion; nausea; unconsciousness; convulsions; headaches; cramps and / or disorientation. If you notice these symptoms in you or in others, immediately stop looking at Virtual Reality content and consult a doctor.

11.3. In particular, untrained 3D consumers may also experience kinetosis, perceptual consequences, disorientation, eye fatigue and reduced stability, headache, fatigue, or dizziness. We recommend that you gradually start using 3D to reduce the likelihood of these side effects and take regular breaks. If you experience any of the above symptoms, stop viewing the Virtual Reality content immediately; do not continue until the symptoms have resolved for at least 30 minutes.

11.4. Children and adolescents should be supervised when consuming 3D media content, also because of their susceptibility to health issues associated with viewing 3D content.

12. Other provisions

12.1. This contract is subject to German law excluding any references to other legal systems and is written in two languages (German /English). The German version shall take precedence over the English version in the event of a dispute arising out of or in connection with the interpretation of this Agreement.

12.2. Amendments and supplements to this contract must be made in writing in order to be effective. This also applies to the amendment of this written form requirement.

12.3. If individual provisions of this terms of use be or become ineffective or if a necessary regulation is not included then this shall not affect the validity of the remaining terms of use.

12.4. The place of jurisdiction and place of performance for the rights and obligations of this contract as well as any disputes arising from and in connection with the execution of the agreement is the registered office of VRdirect, Munich, Germany, as far as legally permissible.

Allgemeine Nutzungsbedingungen – VRdirect App

Die VRdirect GmbH, Einsteinstr. 174, 81677 München, Deutschland, (im Folgenden ‘VRdirect’) stellt über verschiedene Vertriebsplattform (App Store, Google Play Store, Oculus, etc.) eine VRdirect App zum Download bereit. In der VRdirect App können Virtual Reality Inhalte abgerufen und abgespielt werden.

Im Folgenden finden Sie die Allgemeinen Nutzungsbedingungen (im Folgenden ‘Nutzungsbedingungen’) für die VRdirect App. Mit Download bzw. der Verwendung der App erklären Sie (im Folgenden ‘NUTZER’) sich mit der Geltung dieser Nutzungsbedingungen einverstanden. Sie können diese Nutzungsbedingungen in der aktuellen Fassung in der VRdirect App selbst und jederzeit auf unserer Website www.vrdirect.com aufrufen, ausdrucken und speichern.

1. Vertragsschluss
Der Nutzungsvertrag kommt durch den Download zustande. Sie müssen mindestens 16 Jahre alt sein, um die VRdirect App nutzen zu dürfen.

2. Vertragsgegenstand

2.1. Mit der VRdirect App können Virtual Reality Inhalte, die mit der VRdirect Studio Software erstellt und aktuell auf der VRdirect Plattform veröffentlicht und freigegeben sind, abgerufen und abgespielt werden.

2.2. Gegenstand dieses Vertrags ist die Einräumung eines einfachen, nicht-ausschließlichen, nicht unterlizenzierbaren, nichtübertragbaren, unentgeltlichen und zeitlich beschränkten Nutzungsrechts an der VRdirect App und dessen Inhalten.

2.3. Die Nutzungsberechtigung umfasst dabei den Zugang zur VRdirect App sowie die Nutzung der jeweils aktuell verfügbaren Funktionalitäten.

2.4. Die aktuell abrufbaren auf der VRdirect Plattform veröffentlichten Virtual Reality Inhalte dürfen in den Arbeitsspeicher des Endgerätskopiert werden und zur rein persönlichen, nicht-kommerziellen Nutzung abgespielt werden.

2.5. Der NUTZER erhält die App nur in ausführbarer Form. Der Quellcode wird nicht übergeben. Weitergehende Serviceleistungen, wie z.B. Updates, Wartung der App, etc. werden nicht geschuldet.

2.6. Im Übrigen ist es untersagt, die VRdirect App und die in der VRdirect App verfügbaren Inhalte ganz oder teilweise zu bearbeiten, zu verändern, zu übersetzen, vorzuzeigen oder vorzuführen, zu veröffentlichen, auszustellen, zu vervielfältigen oder zu verbreiten. Ebenso ist es untersagt, Urhebervermerke, Logos und sonstige Kennzeichen oder Schutzvermerke, Wiedergaben von Marken und Namen zu nutzen, unkenntlich zu machen, zu entfernen oder zu verändern.

3. Zugang und Funktionen der VRdirect App

3.1. Die VRdirect App wird als Download dem NUTZER zur Verfügung gestellt.

3.2. Für die Installation und Nutzung der VRdirect App sowie dessen Inhalte ist ein internetfähiges Endgerät erforderlich und wird für verschiedene Betriebssysteme bereit gestellt. Bei der Erstinstallation, bei Updates und auch der Nutzung der VRdirect App ist eine Internetverbindung notwendig. Teilweise werden die Daten lokal gespeichert, so dass die VRdirect App für bestimmte Funktionalitäten offline verwendet werden kann. VRdirect ist nicht für die Einhaltung der Systemvoraussetzungen verantwortlich. Diese obliegen ausschließlich dem NUTZER.

3.3. Die Nutzung der VRdirect App erfordert keine Registrierung und kein Passwort.

3.4. Die VRdirect App ist dazu konzipiert, dass Virtual Reality Inhalte, die mit dem VRdirect Studio erstellt und auf der VRdirect Plattformaktuell zur Veröffentlichung freigegeben sind, abgerufen und angesehen werden können.

4. Kosten
Es handelt sich um eine kostenlose App. Für die Bereitstellung und Nutzung der VRdirect App werden keine Kosten oder Gebühren berechnet.
Hinweis: Allerdings müssen Sie für die Erstinstallation, Nutzung und Aktualisierung der VRdirect App bestimmte Endgeräte, Software und Datenverbindungen bereitstellen. Umfang und Häufigkeit der Datenübertragung hängen von Art und Umfang der Nutzung der VRdirect App ab. Sie sind für sämtliche Verbindungskosten bzw. Datentarife und Steuern Ihres Anbieters für die Datenübertragung Ihres mobilen Endgeräts verantwortlich. Die Höhe richtet sich nach Ihrem bestehenden Vertrag mit Ihrem Telekommunikationsanbieter.

5. Verfügbarkeit, Änderungsbefugnis, Aktualisierungen (Updates)

5.1. Ein Anspruch auf die Nutzung der VRdirect App besteht nur im Rahmen der technischen und betrieblichen Möglichkeiten von VRdirect. VRdirect bemüht sich um eine möglichst unterbrechungsfreie Nutzbarkeit der Dienste. Technische Störungen (wie z. B. Unterbrechung der Stromversorgung, Hardware- und Softwarefehler, technische Probleme in den Datenleitungen) können allerdings zu zeitweiligen Beschränkungen oder Unterbrechungen führen. Auf den Transport der Daten über das Internet hat VRdirect keinen Einfluss. Darüber hinaus wird nicht gewährleistet, dass der Datenaustausch mit einer bestimmten Übertragungsgeschwindigkeit erfolgt.

5.2. Software-Updates sind kostenlos. Für den NUTZER der VRdirect App besteht keine Verpflichtung, bereitgestellte Updates zu installieren. Die Funktionsfähigkeit der VRdirect App kann es jedoch erfordern, dass der NUTZER die jeweils aktuellste Version auf seinem Endgerät installiert hat. Dem NUTZER wird empfohlen, die VRdirect App regelmäßig zu aktualisieren.

5.3. VRdirect bemüht sich, die Produkte kontinuierlich an die aktuellen Anforderungen anzupassen. Wir behalten uns daher Änderungen zur Anpassung des Systems an den Stand der Technik, Änderungen zur Optimierung des Systems, insbesondere zur Verbesserung der Nutzerfreundlichkeit, sowie Änderungen an Inhalten wie auch die Einstellung der Dienste vor, sofern dies zur Korrektur von Fehlern, zur Aktualisierung und Vervollständigung, zur programmtechnischen Optimierung und aus lizenzrechtlichen Gründen, oder wenn dies dem technischen Fortschritt geschuldet ist, notwendig erscheint oder ein Missbrauch zu verhindern ist. Die Änderungen können dazu führen, dass das Erscheinungsbild, Navigation oder Funktionen der App verändert werden. Dabei bemüht sich VRdirect die Nutzerfreundlichkeit zu berücksichtigen. Wenn der NUTZER damit nicht einverstanden ist, darf er die App nicht länger nutzen. Setzt der NUTZER die Nutzung fort, akzeptiert der NUTZER die ihm vorgelegten neuen Nutzungsbedingungen und werden die geänderten Bedingungen Bestandteil der Nutzungsbedingungen. VRdirect wird mittels einer Mitteilung auf die Änderungen hinweisen.

6. Haftung und Risikohinweis

6.1. Die App wird kostenlos zur Verfügung gestellt. Es wird daher auf folgendes hingewiesen: Aussagen und Erläuterungen von VRdirect zu der VRdirect App in Werbematerialien, auf Websites sowie in der Dokumentation verstehen sich ausschließlich als Beschreibung der Beschaffenheit und nicht als Garantie oder Zusicherung einer Eigenschaft. VRdirect übernimmt keine Garantien hinsichtlich Verfügbarkeit, Zuverlässigkeit, Funktionalität oder Eignung der App für Ihre Zwecke. VRdirect stellt auch keinen Produkt-Support zur Verfügung.

6.2. Die VRdirect App ermöglicht den Zugriff auf aktuell veröffentlichte Virtual Reality Inhalte auf der VRdirect Plattform. Die Inhalte werden von den Nutzern der VRdirect Plattform erstellt und unterliegen keiner Kontrolle durch VRdirect. VRdirect übernimmt keinerlei Verantwortung oder Gewährleistung für die Vollständigkeit, inhaltliche Richtigkeit, Rechtmäßigkeit, Aktualität sowie Brauchbarkeit der veröffentlichten Virtual Reality Inhalte. Dies gilt auch im Hinblick auf die Qualität der interaktiven Virtual Reality Inhalte und deren Eignung für einen bestimmten Zweck.

6.3. Der VRdirect Player ist nicht dazu konzipiert, sicherheitsrelevante Funktionen bei der Ansicht von Virtual Reality Inhalte abzubilden oder vor Gefahren zu warnen. Von daher erfolgt jedwede Nutzung dieser App auf Ihrer Hardware auf eigenes Risiko.

6.4. VRdirect haftet auf die Wiederherstellung von Daten, für Datenverluste sowie für die Korruption von Daten nur, soweit der NUTZERregelmäßig Sicherungskopien angefertigt und sichergestellt hat, dass die Daten aus diesen Sicherungskopien mit vertretbarem Aufwand rekonstruiert werden können. In diesem Fall ist die Haftung von VRdirect auf den typischerweise vorhersehbaren Schaden begrenzt. Eine darüber hinausgehende Haftung für Datenverlust ist ausgeschlossen.

6.5. VRdirect haftet im Übrigen nur für Vorsatz und grobe Fahrlässigkeit, auch für gesetzliche Vertreter oder Erfüllungsgehilfen. VRdirect haftet unter Begrenzung auf Ersatz des vertragstypischen vorhersehbaren Schadens für solche Schäden, die auf einer leicht fahrlässigen Verletzung wesentlicher Vertragspflichten durch uns oder einen unserer gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen. Vertragswesentliche Pflichten sind Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglichen und auf deren Einhaltung der Vertragspartner regelmäßig vertrauen darf. VRdirect haftet unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie für Schäden wegen der Nichteinhaltung einer von VRdirect gegebenen Garantie oder zugesicherten Eigenschaft oder wegen arglistig verschwiegener Mängel. Die Vorschriften des Produkthaftungsgesetzes bleiben unberührt. Im Übrigen ist die Haftung unabhängig von deren Rechtsgrund ausgeschlossen.

7. Datenschutz
Bei der Nutzung der in der VRdirect App zur Verfügung gestellten Funktionalitäten und Dienste werden keine personenbezogenen Daten durch VRdirect verarbeitet, sofern dies nicht zur vertragsgemäßen Leistungserbringung erforderlich und durch gesetzliche Vorschriften erlaubt, oder vom Gesetzgeber angeordnet ist. 8. Urheberrecht und geistiges Eigentum
Die App und auch die Virtual Reality Inhalte sind sowohl durch das deutsche Urheberrecht und internationale Urheberrechtsverträge als auch durch andere Gesetze und Verträge über geistiges Eigentum geschützt. Die Zusammenstellung der Inhalte als Solche ist ggf. geschützt als Datenbank oder Datenbankwerk. Sie dürfen diese Inhalte lediglich gemäß diesen Nutzungsbedingungen sowie in der VRdirect App vorgegebenen Rahmen nutzen. VRdirect ist Eigentümerin und Inhaberin aller urheberrechtlichen Verwertungsrechte an der VRdirect App und dessen Inhalte bzw. sind die Ersteller der Virtual Reality Inhalte Eigentümer und Inhaber aller urheberrechtlichen Verwertungsrechte an ihren Virtual Reality Inhalte. Durch diese Vereinbarung werden dem NUTZER bestimmte Nutzungsrechte eingeräumt, dagegen werden ihm keinerlei Rechte am geistigen Eigentum eingeräumt.

9. Hochrisikoaktivitäten
Die App und ihre Inhalte sind nicht für die Benutzung in Risiko-Umgebungen, die einen fehlerfreien Betrieb voraussetzen, entwickelt oder vorgesehen. Risiko-Umgebungen schließen insbesondere und ohne Einschränkung den Betrieb von Kernkrafteinrichtungen, Luftfahrtnavigations- oder Kommunikationssystemen, Luftverkehrskontrolleinrichtungen, Waffensystemen, lebenserhaltenden Maschinen oder den Betrieb sämtlicher anderer Anwendungen, bei denen Softwarefehler unmittelbare Gefahr für Leib oder Leben oder erhebliche
Sachschäden nach sich ziehen können (Hochrisikoaktivitäten), ein. VRdirect lehnt deshalb jede vertragliche oder gesetzliche Gewährleistung für die Eignung der App für mit einem hohen Risiko behaftete Aktivitäten ab.

10. Beendigung der Nutzung

10.1. Der Nutzungsvertrag zwischen VRdirect und dem NUTZER für die VRdirect App kommt für unbestimmte Zeit zustande. Das Abrufen der jeweiligen Virtual Reality Inhalte ist nur solange möglich, wie diese jeweils durch den Ersteller bzw. VRdirect zur Veröffentlichung auf der VRdirect Plattform freigegeben sind. Die Beendigung der Nutzung der VRdirect App ist jederzeit möglich, indem Sie den VRdirect Player deinstallieren und den Cache löschen.

10.2. Ungeachtet anderer Rechte ist VRdirect berechtigt, die Nutzungsrechte zu kündigen, wenn in schwerwiegender Weise gegen die Bestimmungen und Bedingungen dieses Vertrags verstoßen wird. Weitere zivil- und strafrechtliche Maßnahmen behält sich VRdirect vor.

11. Wichtige Sicherheitshinweise
Bei Virtual Reality Inhalte handelt es sich um 3D Medieninhalte. Verwenden Sie für den Konsum der Virtual Reality Inhalte ausschließlich qualitativ hochwertige 3D-Brillen und 3D-fähiges Equipment und ausschließlich gemäß deren Betriebsanleitung und unter Beachtung deren Sicherheitshinweise. Im Übrigen lesen Sie bitte folgende Warnhinweise sorgfältig durch:

11.1. Es ist möglich einen epileptischen Anfall zu erleiden, wenn Sie 3D- Medieninhalten ausgesetzt sind. Betrachten Sie daher Virtual Reality Inhalte nicht, wenn Sie an Epilepsie leiden. Außerdem sollten Sie Virtual Reality Inhalte auch nicht konsumieren, wenn Sie schwanger sind, unter starkem Schwindel, Anfällen, unkontrollierter Bewusstlosigkeit, Sehstörungen, Angstzuständen, Herzerkrankungen oder anderen ernsthaften Erkrankungen leiden.

11.2. Bitte beachten Sie, dass folgende Symptome bei Betrachtung von 3D- Medieninhalten auftreten können: unfreiwillige Bewegungen, verändertes Sehvermögen; Schwindel; Benommenheit; Augen- oder Muskelzucken/-ermüdung; Verwirrung; Übelkeit; Bewusstlosigkeit; Zuckungen; Kopfschmerzen; Krämpfe und / oder Desorientiertheit. Falls Sie diese Symptome bei sich oder bei anderen bemerken, unterbrechen Sie umgehend die Betrachtung von Virtual Reality Inhalte und wenden sich an einen Arzt.

11.3. Vor allem bei ungeübte 3D-Konsumenten können zudem beim Betrachten Kinetose, Folgeerscheinungen bezüglich der Wahrnehmung, Desorientiertheit, Augenermüdung und reduzierte Stabilität, Kopfschmerzen, Ermüdung oder Schwindel auftreten. Wir empfehlen Ihnen, zur Reduzierung der Auftretenswahrscheinlichkeit dieser Nebenwirkungen langsam mit dem 3D-Konsum zu beginnen und regelmäßige Pausen einzuhalten. Falls Sie eines der obengenannten Symptome bemerken, unterbrechen Sie umgehend die Betrachtung der VR-Projekte; fahren Sie erst fort, wenn die Symptome mindestens 30 Minuten lang abgeklungen sind.

11.4. Kinder und Jugendliche sollten beim Konsum von 3D-Medieninhalten – auch wegen ihrer Anfälligkeit gegenüber gesundheitlichen Problemen in Verbindung mit dem Betrachten von 3D-Inhalten – beaufsichtigt werden.

12. Sonstige Bestimmungen

12.1. Diese Nutzungsbedingungen unterliegen deutschem Recht unter Ausschluss eventueller Verweisungen auf andere Rechtsordnungen und sind zweisprachig abgefasst (deutsch/englisch). Für den Fall eines Streits aufgrund oder in Zusammenhang mit der Auslegung soll die deutsche Fassung der englischen Fassung vorgehen.

12.2. Änderungen und Ergänzungen dieser Nutzungsbedingungen bedürfen zu ihrer Wirksamkeit der Schriftform. Dies gilt ebenso für die Änderung dieses Schriftformerfordernisses.

12.3. Sollten einzelne Bestimmungen dieser Nutzungsbedingungen unwirksam sein oder werden oder sollte eine an sich notwendige Regelung nicht enthalten sein, so wird dadurch die Wirksamkeit der Nutzungsbedingungen im Übrigen nicht berührt.

12.4. Gerichtsstand und Erfüllungsort ist für Rechte und Pflichten dieser Vereinbarung sowie etwaiger Streitigkeiten aus und im Zusammenhang mit der Durchführung der Vereinbarung der Sitz von VRdirect, München, Deutschland, soweit gesetzlich zulässig.
